  1. Introduction
    1. Commutineer is committed to protecting and respecting your privacy. This page (together with our terms of use and any other documents referred to in them) sets out the basis on which we will process personal data that we collect from you, or that you provide to us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. By submitting your personal data to us or providing it in the course of using the services on the Web site, you will be indicating your agreement to these arrangements.

For the purpose of the Data Protection Act 1998 (referred to below as the DPA), the data controller is Energized Work Limited (trading as Commutineer) (referred to below as Commutineer, we or us). Energized Work Limited is a company registered in England and Wales under company number 6271339 and with its registered office at High Trees, Hillfield Road, Hemel Hempstead, Hertfordshire, HP2 4AY. Our main trading address is 17 Macklin Street, Holborn, London, WC2B 5NR.
  2. What kinds of information may we collect from and about you?

    We may collect and process the following data from and about you:

    1. Information that you provide by filling in forms on the COMMUTINEER.COM Web site (referred to below as the Web site), including without limitation your email address, mobile telephone number and other information provided when you sign up as a registered user.
    2. Information that you provide when you use the services offered on the Web site (referred to below as the services), including details of your favourite topics and locations, and all user generated content that originates with you and that forms part of any conversation with other users of the Web site (whether those conversations are public or private).
    3. Information that you provide when you give feedback or reports problems about the Web site.
    4. Information that you provide when you enter a competition or promotion sponsored by Commutineer, or respond to a survey that we invite you to complete.
    5. Information that is contained in any other correspondence between you and us.
    6. Information concerning your visits to and use of the Web site including, but not limited to, the resources that you access, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise.
  3. How do we use IP addresses and cookies?
    1. We may collect information about any computer or mobile device that you use to access the Web site, including where available your IP address, operating system and browser type, for system administration purposes.
    2. For the same reason, we may obtain information about your use of the Web site by using a cookie file which is stored on the hard drive of your computer or in the memory of your mobile device. Cookies contain information that is transferred to your computer's hard drive or the memory of your mobile device. They are intended to enable us:
      • to improve the Web site and to deliver a better and more personalised service;
      • to estimate our audience size and usage patterns from time to time;
      • to store information about your personal preferences, and so allow us to customise the information that you see on the Web site according to your individual interests;

  4. Where and how do we store your personal data?
    1. The data that we hold about you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff located outside the EEA but who work for us or for one of our suppliers. Such staff may be engaged in, amongst other things, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing outside the EEA.
    2. Please note that the transmission of information via the internet is not completely secure. Although we take steps to protect your personal data, we cannot guarantee the security of information that you transmit to or via the Web site, and any such transmission is at your own risk.

    4. All information you provide to us is securely stored on our servers. All payment transactions are handled by PayPal using their secure payment mechanism. None of your financial information is shared with or stored by Energized Work Limited.
    5. The Web site may, from time to time, contain links to and from the Web sites of our partner networks and affiliates. If you follow a link to any of these Web sites, please note that these Web sites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these Web sites.
  5. What uses do we make of your personal information?

    We will use any information that we obtain about you only for the following purposes:

    1. To ensure that content from the Web site is presented in the most effective manner for you and for your computer or mobile device.
    2. To carry out our obligations arising from any contracts entered into between you and us.
    3. To allow you to participate in interactive features of our service, when you choose to do so (for example, by publicly displaying your user name and your favourite topics and locations as you will not be able to make use of the services without doing so).
    4. To notify you about changes to the Web site or the services offered through it.
  6. What third parties may have access to your personal information?
    1. We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 736 of the UK Companies Act 1985.
    2. We may disclose your personal information to third parties in the following circumstances:
      1. If we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
      2. If Commutineer or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
      3. If we are under a duty to disclose or share your personal data in order to comply with any legal obligation (including without limitation exchanging information with third parties for the purposes of fraud prevention and credit risk reduction).
      4. If disclosure to professional advisers or others is reasonably required in order (i) to enforce or apply our terms of use or any other agreement between us and you, or (ii) to protect the rights, property or safety of Commutineer, its staff and customers, or any third party

We do not disclose information about identifiable individuals to advertisers, but we may provide them with anonymised, aggregated information about our users or to help them reach the kind of audience that they want to target (for example, we may inform them that 50 individuals on a particular route have clicked on their advertisement on any given day).
    4. Where you choose to include personal information such as surnames, telephone numbers, physical addresses, email addresses or other personally identifiable information in your private communications with other registered users, you do so entirely at your own risk. Commutineer accepts no responsibility for any misuse or disclosure of such personal information by any recipient of it.
  7. What rights do users have?
    1. You have the right to ask us not to process your personal data for marketing purposes, or to pass it on to third parties for such purposes. We will usually inform you before collecting your data if we intend to use your data for such purposes, or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking the relevant boxes on the forms we use to collect your data. You can also exercise the right at any time by contacting us.
    2. You have the right to access personal information that we hold about you. Your right of access can be exercised in accordance with the DPA. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.
